appeal against European Commission decision

Aalberts Industries lodged an application before the Court of First Instance of the European Communities in Luxembourg against the Commission of the European Communities. On 20 September 2006, Aalberts Industries was informed by the European Commission that a fine had been imposed on it, due to the alleged violation of EU competition law.

Since Aalberts Industries, including its subsidiaries, are of the opinion that no competition law rules have been broken, no provision will be accounted for. Aalberts Industries will make every effort to contest the decision by all appropriate means. This legal procedure may take a few years.

In accordance with the European Commission decision Aalberts Industries arranged a bank guarantee.
